FlouMe — Terms of Service

Heads-up before launch: this draft was written for FlouMe specifically (location-locked photo sharing — photos pinned where you took them; friends unlock by visiting the spot). 1. Welcome
These Terms of Service (the "Terms") form a legally binding contract between you and [LEGAL ENTITY NAME] ("FlouMe", "we", "us", "our"), the operator of the FlouMe mobile app and any related services (together, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
The way we handle your personal data is described separately in our Privacy Policy, which is incorporated into these Terms by reference.
2. Who can use FlouMe
You must be at least 13 years old to use the Service (or 16 years old if you live in an EU member state that has set the digital consent age at 16). If you are under the age of majority in your country, you must have permission from a parent or legal guardian.
You may not use the Service if you have been previously banned by us, or if applicable export-control or sanctions law prohibits us from providing it to you.
3. Your account
To use most features, you need a FlouMe account. You can create one with an email + password, or by signing in with Google or Apple. You agree that:
- Information you provide is accurate, current, and complete.
- You are responsible for keeping your password and any sign-in tokens secret.
- You are responsible for everything that happens through your account.
- You will tell us at hello@floume.app right away if you suspect someone else is using it.
You can close your account at any time from Settings → Delete Account. Deletion is permanent — see the Privacy Policy for what we erase and what we (and our processors) retain.
4. The core deal: how FlouMe works
FlouMe lets you pin photos to the place where you took them. The photo stays locked until a friend physically arrives at that spot — they walk there, the app verifies their GPS, and the photo unlocks for them. You can also send a private Pin Gift to a specific friend, optionally on a scheduled "opens-later" date, optionally with a voice note attached.
Pieces you should know:
- You decide who can see your photos. Public profiles, friends-only pins, and 1-to-1 Pin Gifts are different visibility scopes.
- We use your GPS to decide whether you have arrived at a pin's location. We compare the GPS you report with the GPS metadata stored on the photo file (an audit-only anti-spoofing check) and refuse the unlock if you are not at the spot.
- You own your photos. You grant us a license to host, display, and deliver them — see §5.
5. Your content
You retain ownership of the photos, voice notes, captions, comments, and other content you submit to FlouMe ("Your Content").
When you submit Your Content, you grant FlouMe a worldwide, royalty-free, sublicensable license to store, copy, transmit, display, and make Your Content available to the recipients you have authorised (your friends, a gift recipient, public viewers of a shared trip token). This license exists for one reason: so we can actually deliver the Service. It ends when you delete the content (with a short cleanup window for caches + processor pipelines).
You promise that:
- Your Content is yours to share, OR you have permission from everyone who appears in it.
- Your Content does not infringe anyone else's copyright, trademark, privacy, or publicity rights.
- Your Content does not violate any law where you live or where the people who can see it live.
6. What you can't do
You agree not to:
- Harass, threaten, dox, or stalk anyone — through pins, gifts, comments, voice notes, or messages.
- Post sexual content involving minors, revenge porn, graphic violence, hate speech, or content that incites violence. This is a zero-tolerance class — any account that does this is terminated immediately and reported to law enforcement where required.
- Spoof your location. Don't fake GPS coordinates, jailbreak / root your device to inject fake fixes, or otherwise game the geofencing system. We may use technical signals (EXIF mismatch, accuracy radius, mocked-location flag) to detect this. Accounts caught spoofing repeatedly will be banned.
- Scrape, copy, or republish other users' photos, profiles, or social-graph information outside the Service.
- Spam, phish, or impersonate other people, brands, or FlouMe staff.
- Reverse-engineer, decompile, or extract parts of FlouMe except to the limited extent required by law.
- Circumvent rate limits, anti-abuse measures, or paywalls (if and when we add them).
- Use FlouMe for commercial purposes without our written permission (e.g. running paid promotional placements, mass-sending gift photos to drive traffic to a third-party service).
- Upload malware, exploit-payload, or anything else that could harm us, our infrastructure, or other users.
We may suspend or terminate your account, remove your content, or refuse the Service at any time if we believe you violated these rules.
7. Reporting + safety
If you see content that violates these Terms, tap the Report action on the photo or profile and choose a reason. We review reports promptly. We may remove content, suspend accounts, restrict features, or escalate to law enforcement at our discretion.
If you believe content infringes your copyright, send a DMCA notice (or equivalent) to hello@floume.app with: (a) identification of the work, (b) identification of the FlouMe content you claim infringes it, (c) your contact information, (d) a statement that you have a good-faith belief the use is not authorised, (e) a statement made under penalty of perjury that the information is accurate and you are authorised to act, (f) your signature.
8. Premium features
The core FlouMe experience is free. We may, in the future, offer paid premium features (e.g. larger photo storage, longer voice notes, custom map themes). If we do, the prices, billing terms, refund policy, and renewal behaviour will be presented to you before you subscribe and form part of these Terms by reference.
9. Third-party services + content
FlouMe relies on third-party services (Supabase, Google Sign-In, Apple Sign in with Apple, Sentry, Expo Push, Apple Maps / Google Maps). Your use of those services is governed by their own terms. We are not responsible for the availability, accuracy, or behaviour of any third-party service.
FlouMe may display links or content from third parties (e.g. a place name resolved via reverse geocoding). We don't endorse and aren't responsible for that content.
10. Termination
You can stop using FlouMe and delete your account at any time. We may suspend or terminate your account if you violate these Terms, or if we are required to do so by law. Where appropriate (and not prohibited by law), we will tell you why and give you a chance to appeal at hello@floume.app.
Provisions that by their nature should survive termination (e.g. §5 content license for content not yet purged, §11–§14, §15) will survive.
11. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that:
- The Service will be uninterrupted, error-free, or secure.
- Defects will be corrected.
- The Service is free of viruses or other harmful components.
Some jurisdictions don't allow disclaimers of implied warranties. To the extent we can't disclaim them in your jurisdiction, those warranties are limited to the maximum extent permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, FlouMe and its officers, employees, agents, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, use, goodwill, or other intangibles, arising out of or related to the Service.
Our total cumulative liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $50.
Nothing in this section limits liability that cannot be limited by law (e.g. for gross negligence, intentional misconduct, or where applicable consumer protection law overrides the limitation).
13. Indemnification
You agree to indemnify and hold harmless FlouMe and its officers, employees, agents, and licensors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of:
- Your violation of these Terms,
- Your violation of any law or third-party right,
- Your Content,
- Your misuse of the Service.
We will tell you about any claim we plan to defend under this clause and let you participate in the defence at your own expense.
14. Governing law + disputes
These Terms are governed by the laws of [JURISDICTION — e.g. the Republic of Indonesia, or the state of Delaware, USA], without regard to its conflict-of-laws rules. The courts located in [VENUE] have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction.
If you live in the European Union and applicable consumer protection law gives you the right to bring proceedings in your home country, that right is not affected.
15. Miscellaneous
- Entire agreement. These Terms (plus the Privacy Policy) form the entire agreement between you and FlouMe regarding the Service.
- No waiver. If we don't enforce a provision, that doesn't waive our right to enforce it later.
- Severability. If any provision is unenforceable, the rest of the Terms remains in effect.
- Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger or sale of our business.
- Notices. We may notify you via in-app message, push notification, or email to the address on file. You can notify us at hello@floume.app.
16. Changes to these Terms
We may update these Terms. Material changes will be notified via in-app notice or email at least 14 days before they take effect. Continued use of the Service after that date means you accept the updated Terms.
